【Pareの商品＆ご依頼及び取り扱いについて】

※こちらの規約は各商品ページにも記載しております。ご依頼、ご購入頂いた時点でここにある全ての規約に了承したものとみなします。※


【1】適用範囲
この規約はクライアントとPare(以下製作者とします)とのやり取り、および納品したイラスト、Live2Dモデル(以下商品)の利用に関わる全てに適用されます。


【2】注意事項
著作権と著作者人格権の放棄はしておりません。本規約の記載に違反した場合、商品の利用停止を求める場合があります。本規約は製作者が必要とした場合、随時追記、修正される場合があります。


【3】お支払いについて
全額前払いをお願いしております。互いのトラブルを防ぐ為ご協力をお願いします。やりとりは互いの安心、安全の為、仲介サイトを介してやりとりをします。それ以外では受け付けておりません。


【4】商品利用許諾範囲​
クライアントは依頼、購入した時点で製作者から商品に関して以下の権利を付与しているものとします。

◆商品を使用しての配信者活動​(Live2Dモデル、配信用立ち絵コミッションで製作者が許可したイラストに限ります)
​◆商品の映り込んだ画像のSNS等への掲載
◆商品を第三者へのイラスト資料としての提示(製作者のデザインしたVモデルや全身イラストを他のイラストレーターに資料として提示し、そのデザインを元に新しいVモデルやライバーになる等はトラブルになりかねないので禁止しております)
◆SNSアイコンやヘッダーへの使用

・上記事項以外は5の禁止事項と照らし合わせた上、依頼者の良識に任せるものとします。不安がある場合はトラブルが起きる前にお問い合わせ頂ければと思います。


【5】禁止事項​
​クライアントは依頼、または商品を購入した時点で以下の行為を行わないことに同意したものとします。

◆法令または公序良俗に違反する行為
◆犯罪行為に関連する行為
◆商品自体の自作発言、転売、トレース
◆商品を利用して著しく常識を欠いた言動
◆商品の原型を留めない程の加工
◆商品を利用している状態で一方的に他人を傷つける言動
◆貶しや自作発言などの目的の悪意を持って画像を加工する行為
◆他人の権利を侵害する行為
​◆他、当方が不適切と判断する行為
◆NFT、AI学習登録、AI編集等の行為。当方のイラストはAI関連への使用は全て禁止です。(Grok等も含む)
◆無許可の商用利用
◆全ての販売しているイラストの許可の無いグッズ化(キャラ販売(adopt)等の既存イラスト含む
◆全ての販売しているイラストの許可の無いモデリング(キャラ販売(adopt)等の既存イラスト含む)。パーツ分け専用コミッションのイラストのみ相談の上許可しています。販売をする場合は別途商用利用の料金が掛かります。
◆実写の性的コンテンツに対しての制作物の使用。創作物の性的コンテンツに限り許可します。(性的コンテンツで活動している配信者や動画投稿等にも使用禁止。)


【6】商品の利用停止
当方は【5】の禁止事項がクライアントに見られた場合、商品の利用の停止を求めることができるものとします。また、商品の利用停止により起きた不利益や損害に制作者は一切の責任を負いません。


【7】その他注意事項
・著作権譲渡は基本的に行いません。著作権譲渡は譲渡するイラスト金額の2倍～3倍の金額が最低金額となりますが、どうしてもという場合ご相談頂ければと思います。

・値下げ交渉は固くお断り致します。

・3日以上返信がない場合、取引の円滑なやり取りが困難だと判断し取引を中止させて頂く場合がございます。納期に影響する、時間を有効に使えない等が起きる為ご了承下さい。

・アバター作成ツール(キャラット、ピクルー等)でイメージを頂く事、イラスト資料無しで文面や口頭でのイメージ等を頂く場合はキャラクターデザイン料金が発生します。

・当方の制作物を使用する際、X(旧Twitter)かBlueskyのID(@Pare_ooo)のクレジット表記を必ずお願いします。X(旧Twitter)へのイラストの掲載はなるべくご遠慮下さると幸いです、どうしても掲載する際は他サイトに画像を掲載し、URLで誘導する等をして下さると助かります。その他のSNSであれば通常通り掲載頂いて構いません。又X(旧Twitter)の機能のGrokで当方のイラストを加工編集する行為も禁止です。見かけた場合今後一切の取引をお断りさせて頂きます。

・ポートフォリオ、SNS等でサンプルとして作品を掲載させて頂く場合があります。

・リテイクの際の大幅な変更は不可。

・完成後の加筆、修正は不可。

・制作者の制作物を商用利用又は収益化する際は追加料金が発生致します。必ずご相談頂きますようお願い申し上げます。

・キャラ販売のキャラクターを配信コンテンツ(IRIAM等)に使用する事はトラブルが多い為禁止しています。立ち絵コミッションのみに許可しておりますのでご相談ください。

・【5】の禁止事項含む、キャラ販売のイラストを用いての許可のないグッズ化、配信での使用、商用利用、自分でパーツを描き差分を増やす、イラストを切り取っての他の画像とのコラージュ、過度な加工(色変更、アイテムや服装の描き込み等)は禁止です。加工はトラブルが多い為、少しでも判断に困る事があればメッセージをお願い致します。TRPG配信でのプレイヤーキャラクターとしての使用は許可しています、その配信による収益化も可能です。その際はクレジット表記を必ずお願い致します。【拡大縮小、トリミング、AI学習禁止の為のノイズ加工は許可しています。】


・PSDデータのレイヤーパーツを他の絵に使用する事は禁止です。PSDデータもイラスト画像同様の規約となります。

・Vや配信者界隈の｢ママ｣、｢パパ｣呼びが苦手な為、クリエイターや製作者等でクレジット記載をお願い致します。

・取引が途中で中止された場合、その取引で製作者がキャラデザをしたキャラクターはadoptやlive2Dとして販売する等の措置を取ります。

・無断転載、AI学習防止の為の加工は許可しております。サイン、ウォーターマーク、ノイズ等の加工をしてのSNS投稿も問題ございません。

【Regarding Pare's Products, Commissions, and Handling】

※These terms are also listed on each product page. By placing an order or making a purchase, you are deemed to have agreed to all terms listed here.※


【1】Scope of Application
These terms apply to all interactions between the client and Pare (hereinafter referred to as the creator), as well as all matters concerning the use of delivered illustrations and Live2D models (hereinafter referred to as products).


【2】Important Notes
The Creator does not waive copyright or moral rights. Violations of these terms may result in requests to cease product usage. These terms may be amended or supplemented at any time as deemed necessary by the Creator.


【3】Payment
Full payment in advance is required. Your cooperation is appreciated to prevent disputes. All communication must occur through the intermediary platform for mutual safety and security. Communication outside this platform is not permitted.


【4】Scope of Product Usage License
Upon commissioning or purchasing the product, the client is deemed to have been granted the following rights by the creator:

◆ Streamer activities using the product (limited to Live2D models and illustrations commissioned for streaming purposes that the creator has explicitly permitted)
◆ Posting images featuring the product on SNS platforms, etc.
◆Presenting the product as reference material to third parties (Presenting the creator's designed V-models or full-body illustrations to other illustrators as reference material, and using that design to create new V-models or streamers, etc., is prohibited as it may lead to disputes)
◆Use as SNS icons or headers

・Any usage beyond the above items shall be left to the client's discretion, subject to comparison with the prohibited items in Section 5. If you have concerns, please contact us before any issues arise.


【5】Prohibited Actions
By placing an order or purchasing the product, the client agrees not to engage in the following actions:

◆Violating laws, regulations, or public order and morals
◆Engaging in activities related to criminal acts
◆Claiming the product as one's own creation, reselling it, or tracing it
◆Using the product to make statements or actions that are grossly lacking in common sense
◆Modifying the product beyond recognition
◆ Unilaterally harming others through words or actions while using the product
◆ Maliciously altering images with intent to disparage or claim ownership
◆ Infringing upon others' rights
◆ Any other acts deemed inappropriate by us
◆ NFTs, AI training registrations, AI editing, etc. All use of our illustrations for AI-related purposes is strictly prohibited (including Grok, etc.)
◆Unauthorized commercial use
◆Unauthorized merchandise creation using any sold illustration (including existing illustrations like character sales/adoptions)
◆Unauthorized modeling using any sold illustration (including existing illustrations like character sales/adoptions). Permission is granted only for illustrations commissioned specifically for part separation, after consultation. Selling such models requires separate commercial use fees.
◆ Use in real-life sexual content. Permission is granted only for sexual content within original creations. (Prohibited for use by streamers or video creators actively producing sexual content.)


【6】Suspension of Product Use
If the client violates any of the prohibitions listed in 【5】, the creator reserves the right to demand suspension of product use. The creator bears no responsibility whatsoever for any disadvantages or damages arising from such suspension.

【7】Other Important Notes
・We generally do not transfer copyright. Copyright transfer requires a minimum fee of 2 to 3 times the illustration's base price. However, if absolutely necessary, please consult with us.

・Price reduction negotiations are strictly declined.

・If there is no response for over 3 days, we may determine that smooth transaction communication is difficult and cancel the transaction. Please understand this is to prevent delays affecting deadlines or inefficient use of time.

・If you provide an image using avatar creation tools (Charatt, Picrew, etc.), or if you provide an image description via text or verbally without any illustration reference materials, a character design fee will apply.

・When using our creations, please always credit the X (formerly Twitter) or Bluesky ID (@Pare_ooo). We would appreciate it if you could refrain from posting illustrations on X (formerly Twitter) whenever possible. If posting is absolutely necessary, please upload the image to another site and provide a URL link instead. Posting on other social media platforms is generally permitted. Additionally, editing or modifying my illustrations using X (formerly Twitter)'s Grok feature is strictly prohibited. Should I discover such activity, I will cease all future transactions with you.

・We may feature completed works as samples in our portfolio or on social media.

・Major changes during retakes are not permitted.

・Post-completion additions or revisions are not permitted.

・Additional fees apply for commercial use or monetization of the creator's work. Please consult us beforehand.

・Using sold characters in streaming content (e.g., IRIAM) is prohibited due to frequent issues. Permission is granted only for standing illustration commissions; please consult us.

・Unauthorized use of character sale illustrations for merchandise, streaming, commercial purposes, creating variations by drawing additional parts yourself, collaging with other images by cropping the illustration, or excessive editing (color changes, adding items/clothing, etc.) is prohibited, including the prohibitions listed in [5]. Editing often leads to issues, so please message us if you have any doubts. Use as a player character in TRPG streams is permitted, and monetization from such streams is allowed. In such cases, please ensure proper credit attribution. [Resizing, cropping, and noise processing to prevent AI training are permitted.]

・Using layer parts from the PSD data in other artwork is prohibited. The PSD data is subject to the same terms as the illustration image.

・As I am uncomfortable with the terms “Mama” or “Papa” commonly used in the VTuber/streamer community, please credit me as the creator or designer.

・If a transaction is canceled midway, the creator will take measures such as selling the character they designed for that transaction as an adopt or Live2D asset.

・Processing for unauthorized reproduction prevention and AI training prevention is permitted. SNS posts with added signatures, watermarks, noise processing, etc., are also acceptable.
