【Pareの商品＆ご依頼及び取り扱いについて】
※こちらの規約は各商品ページにも記載しております。ご依頼、ご購入頂いた時点でここにある全ての規約に了承したものとみなします。※
【1】適用範囲
この規約はクライアントとPare(以下製作者とします)とのやり取り、および納品したイラスト、Live2Dモデル(以下商品)の利用に関わる全てに適用されます。
【2】注意事項
著作権と著作者人格権の放棄はしておりません。本規約の記載に違反した場合、商品の利用停止を求める場合があります。本規約は製作者が必要とした場合、随時追記、修正される場合があります。
【3】お支払いについて
全額前払いをお願いしております。互いのトラブルを防ぐ為ご協力をお願いします。やりとりは互いの安心、安全の為、仲介サイトを介してやりとりをします。それ以外では受け付けておりません。
【4】商品利用許諾範囲
クライアントは依頼、購入した時点で製作者から商品に関して以下の権利を付与しているものとします。
◆商品を使用しての配信者活動(Live2Dモデル、配信用立ち絵コミッションで製作者が許可したイラストに限ります)
◆商品の映り込んだ画像のSNS等への掲載
◆商品を第三者へのイラスト資料としての提示(製作者のデザインしたVモデルや全身イラストを他のイラストレーターに資料として提示し、そのデザインを元に新しいVモデルやライバーになる等はトラブルになりかねないので禁止しております)
◆SNSアイコンやヘッダーへの使用
・上記事項以外は5の禁止事項と照らし合わせた上、依頼者の良識に任せるものとします。不安がある場合はトラブルが起きる前にお問い合わせ頂ければと思います。
【5】禁止事項
クライアントは依頼、または商品を購入した時点で以下の行為を行わないことに同意したものとします。
◆法令または公序良俗に違反する行為
◆犯罪行為に関連する行為
◆商品自体の自作発言、転売
◆商品を利用して著しく常識を欠いた言動
◆商品の原型を留めない程の加工
◆商品を利用している状態で一方的に他人を傷つける言動
◆貶しや自作発言などの目的の悪意を持って画像を加工する行為
◆他人の権利を侵害する行為
◆他、当方が不適切と判断する行為
◆NFT、AI学習登録行為
【6】商品の利用停止
当方は【5】の禁止事項がクライアントに見られた場合、商品の利用の停止を求めることができるものとします。また、商品の利用停止により起きた不利益や損害に制作者は一切の責任を負いません。
【7】その他注意事項
・著作権譲渡は基本的に行いません。著作権譲渡は譲渡するイラスト金額の2倍～3倍の金額が最低金額となりますが、どうしてもという場合ご相談頂ければと思います。
・値下げ交渉は固くお断り致します。
・3日以上返信がない場合、取引の円滑なやり取りが困難だと判断し取引を中止させて頂く場合がございます。納期に影響する、時間を有効に使えない等が起きる為ご了承下さい。
・アバター作成ツール(キャラット、ピクルー等)でイメージを頂く事、イラスト資料無しで文面や口頭でのイメージ等を頂く場合はキャラクターデザイン料金が発生します。
・当方の制作物を使用する際、名前、又はTwitterID(@)のクレジット表記を必ずお願いします。
・ポートフォリオ、SNS等でサンプルとして作品を掲載させて頂く場合があります。
・リテイクの際の大幅な変更は不可。
・完成後の加筆、修正は不可。
・制作者の制作物を商用利用又は収益化する際は追加料金が発生致します。必ずご相談頂きますようお願い申し上げます。
・Live2Dモデルの成人済みコンテンツへの使用は許可しておりません。
・キャラ販売のキャラクターを配信コンテンツ(IRIAM等)に使用する事はトラブルが多い為禁止しています。立ち絵コミッションのみに許可しておりますのでご相談ください。
・【5】の禁止事項含む、キャラ販売のイラストを用いての許可のないグッズ化、配信での使用、商用利用、自分で差分を増やす、過度な加工(色変更、アイテムや服装の描き込み等)は禁止です。加工はトラブルが多い為、少しでも判断に困る事があればメッセージをお願い致します。TRPG配信でのプレイヤーキャラクターとしての使用は許可しています、その配信による収益化も可能です。クレジット表記を必ずお願い致します。
・PSDデータのレイヤーパーツを他の絵に使用する事は禁止です。PSDデータもイラスト画像同様の規約となります。

Pare's Products & Requests and Handling Policy
These terms and conditions are also stated on each product page. We consider that you have agreed to all the terms and conditions when you order or purchase our products. The following terms and conditions are applicable to all products.
【1】Scope of Application
This agreement applies to all communication between the client and Pare (hereinafter referred to as "the creator"), as well as to the use of the delivered illustrations and Live2D models (hereinafter referred to as "the products").
【2】Precautions
Copyright and moral rights are not waived. Violation of any of the provisions of these Terms and Conditions may result in the suspension of the use of the Product. These terms and conditions may be added or modified at any time if the producer deems it necessary.
【3】 About payment
We ask that all payments be made in advance. We ask for your cooperation in order to prevent any trouble between us. For the safety and security of both parties, we will communicate through an intermediary site. We do not accept any other way.
【4】Scope of Product Usage License
The client grants the following rights to the producer of the product at the time of request or purchase.
◆Distributor activities using the products (limited to Live2D models and illustrations approved by the producer in the commission of standing pictures for distribution)
◆Posting of images showing the products on SNS and other social networking sites
◆Providing products to a third party as illustration materials (presenting V-models or full body illustrations designed by the creator to other illustrators as materials and becoming new V-models or lifers based on those designs is prohibited as it may lead to trouble).
◆Use for SNS icons or headers
Other than the above items, we will leave the matter to the good sense of the client in light of the prohibited items in 5. If you have any concerns, please contact us before any trouble occurs.
【5】Prohibited matters
The client agrees not to engage in the following acts upon making a request or purchasing a product.
◆Actions that violate laws and regulations or public order and morals
◆Actions related to criminal acts
◆Self-created statements or resale of the product itself
◆Common sense behavior using the products
◆Modification of the products to the extent that they are no longer in their original state
Words and deeds that unilaterally injure others while using the merchandise
◆Actions that maliciously process images for the purpose of humiliation or self-created remarks
◆Actions that infringe on the rights of others
Other acts that we deem inappropriate
◆NFT, AI study registration act
【6】Suspension of the use of products
We reserve the right to suspend the use of products if any of the prohibited acts listed in [5] are observed by the client. In addition, the producer shall not be liable for any disadvantage or damage caused by the suspension of the use of the product.
【7】 Other precautions
Copyrights will not be transferred in principle. The minimum amount for copyright transfer is two to three times the amount of the illustration to be transferred, but if this is absolutely necessary, please consult with us.
We will not negotiate a lower price.
If we do not receive a reply for more than 3 days, we may consider it difficult to conduct a smooth transaction and may terminate the deal. Please understand that this may affect the delivery date or prevent us from using our time effectively.
If you use avatar creation tools (Carat, Picloo, etc.) to create an image, or if you provide us with a written or verbal image without illustration materials, a character design fee will be incurred.
When using our work, please be sure to credit us with your name or Twitter ID (@).
We may post samples of your work in our portfolio or on social networking sites.
Substantial changes in retakes are not acceptable.
Additions or corrections after completion are not allowed.
